A stab at the sole. Christian Louboutin seeing Red.

We quickly identify the Tiffany blue box,  Burberry’s plaid and Louis Vuitton’s monogram.  Christian Louboutin went through the proper channels when they won a trademark for its red soles with the US Patent and Trademark office in 2008. That’s now being challenged.

Earlier this year, they filed suit against PPR SA’s Yves Saint  Laurent, alleging some of its competitor’s shoes featured soles in shades of red too close to its own.  Last week, a U.S. federal judge denied their request, saying Louboutin could not likely prove its use of the color deserved legal trademark protection. In the judge’s opinion, “Because in the fashion industry color serves ornamental and aesthetic functions vital to robust competition, the court finds that Louboutin in unlikely to be able to prove that its red outsole brand is entitled to trademark protection.” YSL is happy about the decision. “No designer should ever be allowed to monopolize a color.”

Color is trademarked in industrial uses, for instance pink fiberglass insulation to distinguish a product. In fashion, it gets trickier where color services a fundamental purpose. Observers hope this case goes to trial as this is “the most interesting case in fashion intellectual property that has come down in the past couple of years,” according to Susan Scafidi, academic director of the Fashion Law Institute at Fordham Law School.

I side with Louboutin and feel the judge doesn’t realize the big picture Louboutin is fighting here.  Fashion houses work hard to establish an identity. Familiarizing yourself with brands, we can immediately recognize a Valentino bag, Tod, Prada, Kate Spade shoes.   Louboutin did the right thing in 2008, and if competitors want to trademark a signature sole, chose another color and go through the hoops. The WSJ states “ Some in the industry say the recent development just raises more nettlesome questions for designers trying to have some measure of protection for things they consider fashion signatures.”

The downside for the consumer? Brand identity give us quick reference to what price-point but more importantly, fit and comfort for our feet.  While I use this reference for clothing, the styles and trends of the season present more variables in selecting brands we know might fit our bodies. With shoes,  there are typically brands whose styles just don’t work for our feet. Louboutin went through the proper channels in trademarking their brand  in 2008, and I hope this won’t be thrown to the wayside.

So consumers beware; until this is settled, the red-sole might not be what you think it is.

SATC 2 Memorial Day Weekend and invite for “A Woman’s Excellent Extravaganza” brought a purpose to shopping in Palm Beach, Florida, last April. There was the movie pre-party; movie; movie after-party; next day a champagne carriage ride through parks of St. Louis followed by lunch at the St. Louis Woman’s Club.

Shopping for a specific event can be tedious as it seems “I can’t find anything!” when looking, while you find all sorts of items when you’re just browsing. Anyway, BINGO at Saks on Worth Avenue. The nanette lepore dress fit the bill and the hat by Peter Bettley was the prize buy! I wore Prada Calzature Donna Quarzo T-strap heels and flower pearl button earrings by Erwin Pearl.

The sales gals at Saks were great and I shipped items directly to St. Louis for the big event.

 

memorial day 2010 122Of course in the end, we’re our own worst critics. The hat and dress were a lot on their own, so I didn’t wear a necklace. In looking at the pictures, I should have pulled up my dress (eecks – and before 3:00 pm! Champagne will do that!) or a string of pearls would have been fine.  All-in-all I was pleased; I had great luck with beautiful merchandise at Saks! (And an excellent weekend!)

So we had to be ready for the Grammy Awards by 10:30 am. Get up and get ready to go! My Alice + Olivia dress with BCBG stockings; Prada bag; Dior shoes; jewelry and accessories were laid out the night before. We met Grammy nominee Ruthie Foster and entourage in the hotel lobby to board the shuttle to go to the Staples Center for the Red Carpet before the pre-telecast.

The pre-tel was exciting and Taylor Swift won a few Grammy awards, which she accepted in person. She changed her dress before she went to the telecast Grammy Awards. She is a talented young artist!

I started on a project today and Grammy fever took over. Two hours later, I have outfits together, but my bedroom and dressing area look like I was hit by a hurricane!

The dress I’m wearing for Grammy night is from alice + olivia. Stacey Bendet started a great line and I find myself purchasing more and more of this NY native’s designs when I’m looking for something fun. I’ll wear this glamorous little black dress with sheer dot stockings by BCBG and Dior high heels.  Accessories: Lori Bonn earrings; bracelets-one being a purple enameled cuff by Kara Ross; eggplant headband with a big rhinestone in the middle of 5” feathers; purple Prada evening bag. Nars makeup and Estee Lauder Black Amethyst nail polish will complete the outfit.

For the flight to LA and a lunch on Saturday, I’m wearing a fuchsia DVF dress with Stuart Weitzman bone heels. I’ll use the same shoes with a black sexy number from INC for Saturday night. Friday night I have a dress from Free People, wearing with patterned tights from Juicy Couture and Michael by Michael Kors Beverly Sandals in genuine snake. Earrings and bracelets by John Hardy.

I’ll be adding to the pile as I think of things the next few days. I’m determined to have one medium size bag. We’ll see!

Meanwhile, it’s stopped raining in Los Angeles.  Let’s hope we have dry weather for the Red Carpet!

Gals have different needs when it comes to travel and I picked out a few of my favs. If you have an unlimited budget and luggage, go for all five!

 

This Prada navy shoulder bag is my #1 pick for everyday activity. It will be light-weight on the shoulder, zip top, zip pocket, easy to handle. Navy is good if you don’t want to stand out in a crowd, and with Prada, it’s always a winner.

This is definitely more fun for daytime adventures. I like the fuchsia color and Dior logo charm. The wooden-silvertone handles add to the bag’s interest. It appears to have metal feet, which is always a plus for keeping the bag clean. The tote shape is conducive to carrying small trinkets you acquire along your way.

You need the evening bag that will go anywhere.  This is it in my book!  It works for a nice lunch too. And get this: A detachable chain shoulder strap that you can wear as a necklace!  Your shoulder bag becomes a necklace and clutch!  So clever, Miu Miu

I’ve wanted to blog about this night and maybe this is in time for your New Year’s Eve plans. I was invited to the Nordstrom Christmas Party at Waterside Shops in Naples, Florida, where we were met with champagne, wine and delicious hors’oeuvres . I was able tackle my shopping list and had a grand time while doing so! Anyway, what to wear to this event? I went digging in the closet. Sometimes you hold on to a dress because it’s easy to wear, easy to launder and feels great. I brought out a Laundry by Shelli Segal dress that I’ve had for …well…, let’s just say it’s been a while.  I’d been to Chicago 10 days before the party and at Nordstrom bought a great pair of black Christian Dior heels that are fabulous as well as comfortable.  Juicy by Juicy Couture on Oak Street had fun stockings and leggings and I paired these new purchases with my “back of the closet” dress. The John Hardy earrings and bracelet didn’t overwhelm the look and the little eggplant Prada purse added a nice touch. The whole outfit was a big hit and compliments confirmed I did a good job. So if you haven’t picked up a new outfit for your New Year’s Eve party, maybe it’s time to go shopping in your closet!
